PLEASE READ THESE TERMS AND CONDITIONS
CAREFULLY BEFORE ORDERING GOODS FROM LASONIA

The terms and conditions below form the contract between LASONIA and the buyer. Your order of goods is confirmation of your acceptance and agreement with these terms and conditions and to be legally bound by them. LASONIA is not obliged to accept your offer to purchase goods.

INTERPRETATION

‘You’ and ‘Buyer’ means the person(s), organisation or company that buys the goods from us and ‘Your’ shall be interpreted accordingly.

‘LASONIA’ shall mean ‘GEETEX (NZ) LIMITED’ and/or its agents.

‘Us’ and ‘We’ both mean ‘LASONIA’ and ‘our’ shall be interpreted accordingly.

The ‘Terms and Conditions’ detailed herein shall be governed by New Zealand law and any disputes shall be settled in accordance with New Zealand law.

‘Goods’ and ‘Products’ shall mean any goods that LASONIA supplies under the terms and conditions of contract detailed herein.

‘Contract’ means any contract between you and us, for the sale and purchase of goods which incorporates these terms and conditions.

‘Website’ shall mean http://www.lasonianatural.com.

‘Day’ shall mean working or business day and days shall be interpreted accordingly.

‘Buyer’ shall mean the person(s), organisation or company that buys goods from LASONIA.

2. Reference to the singular includes the plural and vice versa.

DESCRIPTION OF GOODS

LASONIA takes care to accurately describe and display products and colours on our website. However, colours and products displayed on our website may look different to the actual product.

Different manufacturers and suppliers have different colour descriptions and the “same” product and colour from suppliers may be slightly different. Herbal Henna has styling flexibility and as a result the supplied Brown, Henna, Charcoal, Copper or Indigo colours may appear different depending on how it is styled.

LASONIA will endeavour to accurately describe and portray goods but takes no responsibility for errors. Pictures, descriptions, specifications or advertising will not form part of the contract. If the goods requested are not available we will provide substitutes.

If you are not happy with the substitute goods we will accept the return of goods. Reference should be made to our Returns and Exchange Policy below.

SHIPPING & DELIVERY

Goods are shipped out within 2 working days of receipt of payment subject to product availability and credit card verification. Allow 72 hours ( 3 working days) for other payment options such as bank deposit or internet banking. Saturday delivery is by special request and will require special payment. Goods will be delivered by post or courier to the address provided on the order form. Any delivery date given by us will be an estimate and we will not be liable for any costs, damages, charges or other expenses caused by late delivery. If the goods cannot be delivered or you will not accept delivery for whatever reason and: -

1. All risk in the goods will pass to you.
2. The goods will be deemed to have been delivered.
3. We may store the goods until you are able to take delivery at your cost.

LASONIA will not be liable for any proven non-delivery to you. Our liability for non-delivery of goods is limited to providing you with details of the shipment. We are not responsible for loss or damage to goods that are delivered to an incorrect address.

LASONIA will not deliver to PO Boxes or any address which we deem suspicious. We ship our goods by post or courier service within New Zealand and internationally. Should you feel that your goods do not arrive in good condition, please feel free to contact us at sales@lasonianatural.com.

LASONIA will be deemed to have delivered the goods when passed to the post or courier service for delivery to you.

PRICE

All prices for goods are quoted in New Zealand Dollars and do not include GST for shipments within New Zealand. Prices are subject to change without notice. The price of goods is the price shown on our website when the order is confirmed. The cost of delivery plus GST if applicable is shown and included in the final price.

PAYMENT

Payment may be made by any of the methods shown on our website. Including credit card (Visa or MasterCard), bank deposit and internet banking.

We will ship goods to you once your payment has been cleared to our account by our bankers. LASONIA reserves the right to conduct a fraud check with our bankers prior to shipment of products. LASONIA may require additional information for large orders.

RETURNS AND EXCHANGES

LASONIA is committed to providing and delivering top quality products and services to our customers. If you receive a product that is defective or you are not satisfied with the product you should notify us within 7 days of receipt by email at sales@lasonianatural.com and include your order number as reference. Returns notified after 7 (seven) days of receipt cannot be accepted.

Returned goods must be in their original packing and not damaged or altered in any way and the contents must be in their original resalable condition. For health and hygiene reasons, products will not be accepted for return if the packaging has been opened. Therefore, DO NOT open packets of products if you want to return for exchange or credit.

The buyer is responsible for any return or exchange shipping costs and shall return goods well packaged by courier with a tracking number. LASONIA will not credit return shipping charges. A copy of the invoice must be included in all returns and your address and telephone number should be clearly and correctly stated in case we need to contact you. LASONIA will not give cash refunds for returned products but will credit your online shopping account. Any credits to your online shopping account will be made within 7 working days.

Protection of children’s personal information; LASONIA is concerned about protecting the safety and privacy of children. We do not knowingly or specifically request or collect personally identifiable information from or about children and do not market specifically to children. We do, however, sell children’s products for purchase by adults.

Cookies; Cookies are pieces of data your web browser stores on your hard drive. We use cookies so we can recognise you when you pay a repeat visit to our website. Cookies let us personalise your shopping experience based on your preferences. We also offer certain features that are only available through the use of a “cookie” and help us provide information which is targeted to your interests. Security; Your privacy and security are very important to us. LASONIA uses the best security available for on-line purchasing. When you click the “Add to Shopping Cart” button, LASONIA automatically checks to see that you have a secure connection. LASONIA uses Secure Sockets Layer (SSL), an encryption technology that works with the following browsers: Netscape Navigator, Microsoft Internet Explorer, and AOL (America Online). If your browser does not support SSL, you will need to upgrade to a new version of Netscape Navigator, Internet Explorer, or AOL that does for on-line purchases. You may also email, fax, mail or phone in your order. As part of LASONIA privacy and security practices, we do not store your credit card number in your file or order history. We request you kindly provide us with your credit card number every time you make an order or a secure transaction.

Other legal notices; Our Privacy Policy applies only to LASONIA and not to other companies’ or organisations’ sites to which we link or to which you otherwise provide your information. Accessing third party websites or sources requires you to leave our website. We do not control those third party websites or any of the content contained therein and you expressly acknowledge and agree that we are in no way responsible or liable for any of those third party websites, including, without limitation, their content, policies, failures, promotions, products, services on or actions of those websites and/or any damages, losses, failures or problems caused by, related to or arising from those websites. LASONIA encourages you to review all policies, rules, terms and regulations, including the privacy policies, of each website that you visit. We may change this Privacy Policy from time to time based on your comment, changes in the law and our need to accurately reflect our data collection and disclosure practices. If you are concerned about how your information is used, please check our website periodically to review our current Privacy Policy. Also you are continued viewing of or use of our website and your continued transaction of business with LASONIA following the posting of any changes to this Privacy Policy will signify your assent to any such changes or amendments. This Privacy Policy is not intended to and does not create any contractual or other legal rights in or on behalf of any party. LASONIA is committed to treating your personal information in a confidential manner. GOODS AND SERVICES TAX (GST)

LASONIA is required by law to charge GST on all purchases made in New Zealand at a current rate OF 15%.

FORCE MAJEURE

If we are unable to carry out our business due to circumstances beyond our control we may reduce the volume of goods shipped, cancel delivery, or cancel the contract. Such circumstances include acts of God, Government actions, war, embargo, national emergency, fire, explosion, acts of terror, lockouts, flood, fire, epidemic, etc. If the circumstances in question continue for a continuous period of more than 10 days you may give us written notice to cancel the contract.

LIABILITY

Due to the lack of control we have over application and operation procedures for the use of glue, glue guns and other application tools, LASONIA cannot accept any responsibility whatsoever for any damage or injury caused to users of the products.

LASONIA shall not be liable for any loss or profits, or any consequential, indirect or special loss, or damage, or loss of any kind, arising directly or indirectly from any breach of LASONIA obligations under this contract or in tort. Where LASONIA is liable to the buyer, the maximum cost of any liability shall not exceed the value of the goods, products or services provided to the buyer. LASONIA accept no responsibility for the actions of the buyer or the buyer’s wrongful use of goods purchased from LASONIA. We do not control, endorse or assume responsibility for any product, brand, method, treatment, information or services displayed on the website in any way.

NON WAIVER

Failure by LASONIA to enforce any of the terms and conditions shall not be deemed to be a waiver of any of the rights or obligations LASONIA has under the contract.

DISCLAIMER

Product descriptions, typographic, pricing and photographic errors are unintentional and subject to correction. We regret, but are not liable for these errors.

WARRANTY

LASONIA supplies certain items with a warranty against failure. As warranty conditions and terms vary for different manufacturers and items we request you refer to the conditions attached with each purchase.
